This Privacy Policy (this “Policy”) describes how TriYum LLC (“TriYum,” “we,” “us,” or “our”) collects, uses, shares, and protects information provided by or collected from individuals who use TriYum’s consumer-facing websites, mobile application, and related services to browse merchants, place orders, and coordinate deliveries (collectively, the “Consumer Platform”).
This Policy applies only to consumers who use the Consumer Platform. If you interact with TriYum in another capacity, such as a merchant or driver subscriber, please refer to the privacy policy applicable to that relationship.
1. Information We Collect
We may collect information you provide directly to us, information collected through your use of the Consumer Platform, and information we receive from third parties involved in operating the Consumer Platform.
A. Information You Provide to Us
When you create an account, place an order, request support, communicate with us, or otherwise use the Consumer Platform, we may collect information such as:
- your name;
- email address;
- telephone number;
- username and password or other account credentials;
- delivery address and related order instructions;
- order details and purchase history;
- payment-related information processed through our payment providers;
- communications you send through the Consumer Platform; and
- information you provide when contacting us for support.
B. Information Collected Through Use of the Consumer Platform
When you visit, access, or use the Consumer Platform, we may collect certain technical and usage information, including:
- IP address;
- browser type;
- operating system;
- mobile device type;
- app or software version;
- log files and diagnostic information;
- pages, screens, or features viewed or used;
- dates and times of access; and
- crash reports, performance data, and related technical information.
C. Location and Navigation Information
The Consumer Platform may use location-related information you provide, such as a delivery address you manually enter in order to help display nearby merchants, support delivery functions, or improve order accuracy.
The Consumer Platform does not automatically track your real-time location through your phone or device for delivery fulfillment.
If you do not provide the requested address or other location-related information, some features of the Consumer Platform may be unavailable or may not function as intended.
D. Transaction and Order Information
We may collect information relating to your use of the Consumer Platform, including:
- items ordered;
- merchant selected;
- delivery details;
- transaction history;
- customer support history;
- records relating to disputes, refunds, complaints, or order issues; and
- information necessary to support order-status notifications and legally required delivery-status disclosures.
E. Information from Third Parties
We may receive information about you from third parties involved in operating the Consumer Platform, including:
- payment processors;
- communications and customer support providers;
- merchants involved in your order;
- delivery subscribers involved in fulfillment;
- cloud hosting providers; and
- fraud prevention and security providers.
2. How We Collect Your Information
We collect information in several ways.
A. Information You Provide Directly
We collect information you provide to us when you:
- create an account;
- place an order;
- enter a delivery address or special instructions;
- request support, services, or information; or
- communicate with us by email, phone, text, chat, or other means.
If you provide information through a third-party site, service, or platform, that third party may also collect the information you provide, subject to its own privacy practices.
B. Platform and Technical Collection
As you enter or use the Consumer Platform, we may capture and retain technical information associated with your access to the Consumer Platform, including device and system information reasonably necessary to operate, secure, and maintain the Consumer Platform.
C. Communications and Related Platforms
If you request support, sign up for communications, or otherwise interact with TriYum through connected communications or support platforms, information you provide may be processed through those platforms.
3. What We Do With Your Information
We may use your information for the following purposes:
A. To Provide and Operate the Consumer Platform
- create, maintain, and administer your account;
- authenticate users and allow access to the Consumer Platform;
- facilitate order placement, routing, and related platform functions;
- coordinate order fulfillment among TriYum, merchants, and delivery subscribers; and
- maintain records relating to use of the Consumer Platform.
B. To Support Orders and Deliveries
- transmit order details to the selected merchant;
- transmit delivery information needed to complete the order;
- provide order-status updates;
- provide driver-identifying information to consumers where required by applicable law; and
- address delivery-related issues, disputes, or support requests.
C. To Communicate With You
- contact you regarding your orders, support requests, or account;
- send service notices, security alerts, updates, receipts, and administrative messages;
- communicate with you about features, functionality, or changes to the Consumer Platform; and
- send marketing or promotional communications, subject to your choices and applicable law.
D. To Protect Rights, Safety, and Security
- protect TriYum, merchants, delivery subscribers, consumers, and the public;
- detect, investigate, and prevent fraud, abuse, or unauthorized access;
- enforce our agreements, terms, and policies; and
- investigate complaints, incidents, disputes, or suspected misconduct.
E. For Legal and Compliance Purposes
- comply with legal, tax, accounting, regulatory, and recordkeeping obligations;
- respond to subpoenas, court orders, legal process, or lawful government requests; and
- establish, exercise, or defend legal claims.
F. With Your Consent or Direction
- for any other purpose disclosed at the time of collection; or
- with your consent or at your direction.
4. Sharing Your Information
We may share information as described below.
A. Merchants and Delivery Subscribers
We may share limited information with merchants and delivery subscribers when necessary to facilitate your order.
For example:
- TriYum may provide the merchant with your first name, order details, and information needed to prepare the order.
- TriYum may provide the delivery subscriber with the merchant location, your delivery address, and information needed to complete the delivery.
Where required by applicable law, TriYum may also provide you, through the Consumer Platform, with the driver’s first name and picture when the order is out for delivery.
B. Service Providers
We may share information with third-party service providers or contractors that perform services on our behalf, such as:
- payment processing;
- hosting, storage, and cloud services;
- customer support and communications;
- fraud prevention and security; and
- technical support.
These service providers may access personal information only as needed to perform services for us and for other permitted purposes consistent with applicable law.
C. Affiliates and Corporate Transactions
We may share information with our affiliates for internal business, operational, administrative, and security purposes.
If TriYum or any portion of its assets is acquired, merged, reorganized, financed, sold, or transferred, your information may be disclosed or transferred as part of that transaction.
D. At Your Direction
We may share your information with third parties when you direct us to do so.
E. Legal Process and Protection
We may disclose information as required by law or as reasonably necessary to:
- comply with legal obligations or legal process;
- respond to lawful requests from courts, regulators, or law enforcement;
- enforce our agreements or policies;
- protect the rights, property, or safety of TriYum, our users, or others; or

5. Your Controls and Choices
We provide you with certain controls and choices regarding the collection, use, and sharing of your information.
Depending on the Consumer Platform’s features and applicable law, you may be able to:
- access, review, correct, or update account information;
- change your preferences for alerts or communications;
- opt out of promotional emails by using the unsubscribe link in those messages;
- request access to, correction of, or deletion of certain personal information we hold about you, subject to applicable law; and
- request account closure, subject to our need to retain certain information for legal, security, accounting, or operational reasons.
6. Security Measures
We use reasonable administrative, technical, and physical safeguards designed to protect personal information.
Please be aware, however, that no security measures are perfect or impenetrable, and we cannot guarantee absolute security.
You are responsible for maintaining the confidentiality of your account credentials and notifying us promptly if you believe your account has been compromised.
7. How We Communicate with You
We may communicate with you by email, telephone, text message, push notification, in-app message, or mail regarding:
- your account or subscription;
- transactions or delivery activity;
- support issues;
- platform updates;
- policy changes;
- security matters; and
- marketing or promotional communications, where permitted.

8. Children
The Consumer Platform is not directed to children under 13. If we learn that we have collected personal information from a child under 13 without appropriate authorization, we will take reasonable steps to delete that information.
9. Changes to This Policy
From time to time, we may change this Policy to reflect new technologies, legal requirements, industry practices, or changes to the Consumer Platform.
If we make material changes, we will update the “Last Updated” date above and provide additional notice where required by applicable law.
10. Notice to California Residents
If you are a California resident, California law may provide you with certain rights regarding your personal information, subject to applicable exceptions and verification requirements. California rights include the rights to know, delete, correct, opt out of sale or sharing if applicable, limit the use of sensitive personal information if applicable, and not be discriminated against for exercising those rights.
A. Categories of Personal Information We May Collect
Depending on how you interact with the Consumer Platform, we may collect the following categories of personal information:
- identifiers and contact information;
- customer records information;
- commercial information;
- internet or other electronic network activity information;
- geolocation information, if applicable;
- visual information, where applicable, such as driver-identifying images displayed to consumers as part of delivery-status notifications required by law; and
- sensitive personal information, where applicable, such as account log-in credentials combined with a password or other access code.
B. Your California Privacy Rights
Subject to applicable law and verification requirements, California residents may have the right to:
- know the categories of personal information we collect, use, disclose, sell, or share;
- access specific pieces of personal information we have collected about them;
- request deletion of personal information we collected from them;
- request correction of inaccurate personal information we maintain about them;
- opt out of the sale or sharing of personal information, if applicable;
- limit the use and disclosure of sensitive personal information, if applicable; and
- not receive discriminatory treatment for exercising privacy rights.

We may need to verify your identity before processing certain requests. We generally respond to verified consumer requests within 45 days, although we may extend the response period as permitted by law.
C. Sale or Sharing of Personal Information
TriYum does not sell or share personal information as those terms are defined under California law.
D. Sensitive Personal Information
TriYum uses sensitive personal information only as reasonably necessary for order administration, account administration, fraud prevention, legal compliance, security, and providing the Consumer Platform.
E. Shine the Light
California Civil Code section 1798.83 may permit California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes.
11. California Do Not Track and Privacy Preference Signals
Some browsers offer a “Do Not Track” setting. Because there is not a uniform industry standard for Do Not Track signals, our websites may not respond to those signals in all contexts.
If TriYum is required by applicable law to recognize browser-based opt-out preference signals, such as the Global Privacy Control, we will process such signals in accordance with applicable law.
12. Data Retention
We retain personal information for as long as reasonably necessary for the purposes described in this Policy, including to:
- provide the Consumer Platform;
- maintain order and transaction records;
- comply with legal, accounting, tax, and regulatory obligations;
- resolve disputes;
- enforce agreements and policies; and
- protect against fraud, misuse, or security incidents.
13. International Use
- TriYum is based in the United States, and personal information may be collected, processed, stored, and transferred in the United States or other jurisdictions where we or our service providers operate.
- By using the Consumer Platform, you understand that your information may be transferred to jurisdictions that may have different data protection laws than those in your location.
